Collision and Comprehensive Damage Waiver (CCDW) Agreement:

This Collision and Comprehensive Damage Waiver (“Agreement” or "CCDW") is entered between Mid Michigan RV Rental LLC, a Michigan business (“Owner”), and The Listed Renter (“Renter”), in connection with the rental of the travel trailer described in the Rental Agreement.

This Agreement provides the Renter with the option to purchase a Collision and Comprehensive Damage Waiver (CCDW) that limits their financial responsibility for accidental physical damage, loss, or destruction of the Trailer during the rental period due to covered causes.

This waiver is not insurance. It is a contractual agreement between the Owner and Renter that determines the Renter’s financial responsibility under the terms below. 

If the Renter purchases the CCDW, the Owner agrees to waive the Renter’s financial responsibility for direct physical loss or damage to the Trailer caused by:

• Collision with another vehicle, object, or structure;
• Accidental overturn of the Trailer while being towed by an authorized vehicle;
• Impact-related damage resulting from a collision.
  

• Fire, explosion, or lightning;
• Vandalism;
• Falling objects, hail, wind, or storm damage;
• Animal impact
  

Coverage applies only to the Trailer unit and its permanently attached components, up to a limit of $15,000 per rental period and subject to the exclusions in Section 3. 

 The CCDW does not apply to:

1. Damage resulting from negligent, careless, or reckless operation, including off-road or unpaved road use;
2. Damage while towing with an unauthorized or improperly equipped vehicle;
3. Damage caused intentionally or due to misuse, abuse, or overloading;
4. Damage to interior furnishings or appliances, unless caused by a covered peril;
5. Damage to personal belongings;
6. Damage occurring while the Trailer is used in violation of Michigan law (MCL §257.1 et seq.);
7. Loss or damage occurring while the Renter or operator is under the influence of alcohol, drugs, or other intoxicants;
8. Damage caused by flooding, plumbing issues, smoking, cooking fires, pets, or unattended heat sources;
9. Tire damage not resulting from a collision or covered peril;
10. Loss of use, towing charges, or diminution of value;
11. Damage occurring while the Trailer is sub-rented, assigned, or used for commercial transport;
12. Acts of war, nuclear hazards, or government seizure.
13. Damage that occurs from the continuance of use when it is/was likely that such use would further damage the vehicle. 

• The Renter must immediately report any accident, theft, vandalism, or damage to the Owner and, if applicable, local law enforcement.
• The Renter must cooperate fully in any investigation or claim and provide all relevant documentation.
• Failure to report damage promptly may void this waiver.
• The Renter remains responsible for all excluded losses and the deductible described below.

A deductible of $1,000 per occurrence applies. The Renter is responsible for all repair costs up to this deductible amount before CCDW benefits apply. 

The CCDW is optional and may be purchased for a daily rate. The charge must be accepted and paid in full prior to the start of the rental period and is non-refundable once the rental begins. 

 If the Renter declines the CCDW, they agree to be fully responsible for any and all loss or damage to the Trailer, regardless of fault, up to the full replacement value of the Trailer and its permanently attached equipment.

The Renter acknowledges that personal auto or homeowner’s insurance may not cover rented trailers under Michigan’s No-Fault Insurance Act (MCL §500.3101 et seq.), and they are encouraged to verify their own coverage before declining this waiver. 

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, and any disputes shall be resolved in the courts of Alcona County, Michigan. 

By signing, the Renter acknowledges that they have read, understood, and agreed to the terms of this Collision and Comprehensive Damage Waiver and have indicated whether they elect to purchase it by including it with their rental or declining it.

This Collision and Comprehensive Damage Waiver is not insurance. It is a contractual option offered by the Owner to limit your financial responsibility for certain types of accidental damage or loss under Michigan law. It does not provide liability coverage or personal injury protection.
